The purchase of products from this web site is governed by these terms and conditions. By submitting an order you agree to our company’s terms and conditions, which are based upon current main online shopping regulations. Please read them carefully as they contain important information. We reserve the right to change, modify, substitute or remove, without notice, any information on this site as necessary.
Terms of Sale
Payment must be via Paypal, a secure payment processing provider. Or by Debit or Credit card.
Prices are in £UK and are correct at the time of currency.
All prices include VAT at current rates.
Items are sold subject to availability.
We supply to the UK mainland only. Despatch is within 2-3 working days of receipt of the order. This may vary over public holidays or during particularly hot spells when we will delay postage of live plants.
All goods are subject to availability and we will endeavor to inform the customer of any items that are unavailable as soon as possible. Products may vary slightly in colour from the described item. Bonsai and plants are individually unique; no two are the same. Unless expressly mentioned in a listing; the Bonsai or plant that will be delivered to the customer will not be the item pictured.
Promotions & discount codes
These terms and conditions apply for all promotions. Discounts codes are offered for single use by one customer/email address only and according to the details of the stated offer. The codes will be valid for a disclosed time period and after this time cannot be claimed. More than one code cannot be applied at the same time. Please note, that additional discounts such as free shipping will still be valid if the defined order value conditions are met. Competitions are valid for the period as stated. All competitions are free to enter, terms of entry will be outlined in the specific competition terms. Winner will have 7 days to claim the prize, after this period a second winner will be selected and so on until the prize is claimed.
The Japanese Garden will not be liable in respect of customer or third party recipient failure to comply with product safety instructions resulting in willful damage to/or loss of whether direct or consequential to personal property. The Japanese Garden will not be liable for loss or damage to live plants in respect of the customer not correctly caring for their purchases.
If delivery cannot be made* and is returned to The Japanese Garden; The Japanese Garden are not liable to post the item a second time. A refund will be offered for the items returned, minus the postage costs incurred.
A second delivery can be attempted at the customers request with postage costs being paid for by the customer.
* If the courier attempts to deliver but no-one is available to take receipt of the parcel and no delivery instructions have been left, a second attempt will usually be made, or a note will be left to inform where the parcel is available to be collected. If no action is taken and the parcel cannot be delivered it will be returned to The Japanese Garden.
Breakage Claims, Incorrect Orders and Goods Not Received
If the goods supplied are damaged or are not what you ordered The Japanese Garden shall have no liability to you unless you notify the Company of the problem by 6pm on the day after delivery. All original transit packaging and damaged items must be kept until the claim has been reported and appropriate action decided. Any box that arrives damaged can be signed for as such and retained (remember to report by 6pm the next day) or alternatively the goods can be refused and subsequently returned to us.
If goods are not received within 7 working days from the order/ invoice date please notify the Company.
Notification of Breakage Claims, Incorrect Orders and Goods Not Received should be made by email to: firstname.lastname@example.org and it should be made clear if replacements or a refund are required. Once these conditions have been met The Japanese Garden’s obligation will be to issue replacement goods for non-deliveries and damaged goods. Refunds are at the discretion of the Company.
We accept online payments via Paypal, Visa, MasterCard, Maestro, Switch and Solo. All prices are inclusive of VAT and we reserve the right to amend prices otherwise stated. The total cost of your order is the price of the products plus delivery charges as quoted on the delivery page of the website and also on your order confirmation. The displayed price on the order confirmation is the amount in pounds sterling that you will pay.
You have the right to cancel your order within 24 hours.
You will be liable for any postage costs incurred as a result of returning an item to The Japanese Garden. A refund can only be given provided for items returned and on inspection are in perfect condition.
Please make sure adequate postage cover (insurance for the cost of the item) is obtained when sending an item back; The Japanese Garden cannot issue a refund until an item is returned and inspected for damage.

The contract between us shall be governed by and interpreted in accordance with English Law, and the English courts shall have jurisdiction to resolve any disputes between us. Nothing in these Terms and Conditions affects your Statutory Rights. Errors and omissions excepted. We have taken care to describe items as accurately as possible; however slight variations may occur due to the handmade nature of many of our products. Live plants are unique and no two are exactly the same.
